  • Work accident claim

    Hi,

I work as a sales executive on a holiday park, part of my job is to show people round the park, we use 6 seater golf buggies for this purpose.

In March my sales manager at the time (he is no longer with the company) came in to the office to get something and then asked me to give him a lift back to his caravan where he was living.

I went round a corner and he fell out and banged his head and he hurt his ankle. He went to hospital the next day and he had mild concussion and tore the ligaments in his ankle.

About a week ago my company received a claim from him. I have submitted a statement and our insurance company solicitors want to speak to me.

My ex sales manager is an alcoholic and was intoxicated at the time, I believe this to be why he fell out.

I guess what I would like to know is if there is any come back on me, or just the company, would hate to think I would be personally sued as I did nothing wrong.

Should I speak to the solicitors on my own?

    Thanks for your help

    Re: Work accident claim

    Hi and welcome
Is he alleging his accident was due to your poor driving?
As you were acting on his instructions as your superior any claim will be made against the company.
If he were to try and involve you personally, you would be covered by your employers liability policy anyway
Your company will have an employer's liability policy, hence the insurers request to speak to you.
No need to instruct your own solicitors

      Hi Des,

Thanks for the welcome and help.

That's reassuring, I believe he is blaming my driving, does this make a difference?

        Not really
Employers’ liability insurance protects employees if they are injured as a result of an accident
        if the employer is responsible.
As you were acting in the course of your employment, the liability cover effected by your employer becomes operative
