legal charge on sale of property

Morning all.
My wife is stc on her home which has a legal charge on it but her ex husband is not willing to sign the ds1 form to allow it to go through. I have been told to go to court to get the charge either removed or forced through. Can someone help please as the sale of the property will fall through. Many thanks.
