  • The OFT meet Legal Beagles - any questions ?

    We are delighted to have been invited to a roundtable meeting with Gover James et al in the Retail Banking Team of the Office of Fair Trading on Monday 22nd September.

    This will be a few days after the banks and super consumer groups (Which? & CAB) meet with the OFT to discuss the PCA report responses.

    EXC, Celestine, Budgie and Tom Brennan will be attending.

    The primary topic of discussion will be the PCA report and will encompass aspects of the test case relevant to the OFT's involvement.


    If you have any questions or comments you would like putting forward please post in this thread and we will try our darnest to get some answers.

    This is a fantastic opportunity for Beagles and we thank the OFT for extending the invitation to us.

      Not as far as I am aware but now we have fixed a date they may extend the invitation.

            hi

            i have 2 questions id like raised.

            1) what happens regarding statute of limitation should the case go the way we want. will those not in court be loosing years of potential claims.

            2) related to that can claims over 6 years be entertained?

                  How about asking them if they are aware that the banks, specifically Barclays (that I know of anyway) are selling accounts awaiting a charges refund but are currently stayed and have been for some time, to debt collection agencies - which is a direct contravention of the FSA waiver rules.

                  Also ask them what action they plan to take against the banks for this poor practice and how they plan to stop it becoming common place.

                          Sorry is this just about the technicalities of the case? Or how the banks can improve things in the future?

                              Ok

                              What about a universal trigger on charges where if a person reaches a certain amount of charges in a short amount of time flagging up financial difficulties they are very quickly automatically moved to a basic account and the other account is frozen for say 14 days to give them a chance to sort out what the problems are and how they can be resolved.

                              That would stop the charges on charges scenario and also in some cases stop people getting themselves into more trouble.

                              If there is no resolution or the customer wants to increase OD or pay the charges at least everyone knows where they stand without escalation of the situation.

                              This would apply even if charges are reduced in the future.
