''A two-stage approach will be adopted, whereby some information will be provided to debtors as of right, with other documents available on request.''

be interesting to see what those documents are...

Ah, when this was first bandied about it looked so promising.
So the proposal may be…. The creditor /DCA will provide some documents when they hit the alleged debtor with court claim. Then they will be obliged to supply some documents to the alleged debtor if they respond and intend to defend and request them. Oh, and all documents will be in clearer language, that is to say what the CPRC ( Cowardly P***ks Romancing Claimants) consider to be clear language.
Unless the claimant has to produce some form of historical paperwork or supporting documents when they apply to the court I really cannot see a huge benefit here. Otherwise it is the same old pick a name, address and an amount and gamble the court fee. Good odds of getting tons of money in when you can terrorise people.
A quick browse on LB’s will tell you that already there are many, many rules and regulations that creditors and DCAs should abide by when hauling someone over the coals. An even shorter glance will show these rules are constantly ignored and flaunted. Until the court insists these vultures must produce proper supporting documents before the court process begins nothing will change.
Oh and another thing……Can a DCA be a creditor? Does this just apply to OCs or do the DCAs come under the umbrella? I mean, they don’t provide credit services in any form. Anyway, they take no notice of law or consumer rights now so I cannot see this watered down and toothless proposal bothering them.
