    If someone is administering the estate without a grant of representation because the estate is small, I can't see why HMRC would raise any queries, as long as any tax liability is met.
    The person administering the estate would probably be liable for ensuring the tax is paid.

    Is the business still being run?
    This may not apply, as I don't know what this business is but:
    1) Claims can be made against the business for upto 6 years after death
    2)was a section 27 notice publishedto protect the administrators
    3) have they taken out an executors liability insurance

    Depending on the business he might consider the above

      The the deceased's business terminated on his death. Unable to answer the remaining questions because I, as his partner appears to have been excluded from the loop.
      I realise that as an umarried partner I have no legal rights as such, but just trying to clarify the required procedure

        Problem is that depending on the business, claims can arise later which can be made against his estate.
        If the estate hasn't been dealt with properly the administrator could find themselves having to deal with the claim.
        Obviously this is not a problem for most businesses.
