    hello all.


    my father has recently passed away and has left a sum of around £19000 in a sipp.


    when he was alive he was claiming jsa.
    im not sure if it was income or contribution based.


    I have recently received a letter from the dwp which states they will be looking into any overpayments made to him which will be deducted from my fathers estate.


    The question im asking is would he of had to declare his sipp when he was claiming jsa and if he never will I be responsible for any money he owes to them?


    As far as im aware he was not receiving any income from his sipp he was just transferring money between two sipps.


    i have recently found out he also transferred £50.000 from one pension into a carbon credits scheme which turned out to be a massive scam so he had lost most of his life savings.


    If anyone out there could point me in the right direction in regards to what happens next i would be grateful.

    If it was income-based JSA he would not have been eligible if he had savings, pensions or investments over £16,000.
    For an amount between £6,000 and £16,000 there is a sliding scale.
    People can only claim contribution-based JSA for 6 months, so it would be income-based if he was claiming longer.
    This would be benefits fraud, pure and simple.
    The DWP are terrible to deal with. I was in the position of sorting my late father's affairs out. They come after you with the proverbial sledgehammer.

      Thank you for your reply sean. I have since found out from my fathers letters that it was contribution based jobseekers he was on.
      like you said the DWP are a bit savage to deal with.
      The attitude from the person I spoke to on the phone was awful.

        Hi,
        As has been said Job Seekers' Allowance contribution-based is paid for a maximum of six months. After that, you can instead be considered for Job Seekers Allowance Income Based which depends upon your income and savings. Think you need to find out how long he was claiming and if it did go from contribution to income based as they will reclaim all overpayments from the estate.
