      Thanks for the post MissFM.
      Just one point to clarify> in probate litigation costs aren't necessarily awarded from the estate. Costs are at the discretion of the court and it is becoming more common for the unsuccessful party ordered to bear them.

              Miss FM, the solicitor made an interim payout so the grandchildren could have their legacies from bank accounts, investments etc and witheld £5,000 from each of the 3 of us so she had a £15,000 float. So at the moment it is being used up, but not affecting his pocket.

                  Is the solicitor an executor named in the will, or one appointed by one or all three of you to act on your/their behalf?
                  As MissFM suggests that solicitor is only interested in spinning it out until the estate is dry.
                  IMO she should be advising you all how to resolve the problems.
                  Agreed she has to remain impartial, but it shouldn't be beyond her wit to encourage all three of you to find a way forward.
                  Has she warned you about spiralling costs and deterioration of the property?
                  Perhaps she is not au fait with contentious probate and is just a general solicitor.

                    Hi des8, she is not an executor and was appointed by the three of us as her firm drew up the wills and dealt with the Land Registry and acted for my parents. We thought it would make life easier and not realising the problems that have unfolded since.
