  • Request copy of Deed of Variation

    Hi all, my mothers interstate probate has now completed. And we have been sent the letter of administration to allow us to share our the estate.
    As this went through Interstate, when the IHT400 was submitted to the HMRC, we had to include and send the original Deed of Variation (DOV) document, that was signed by all parties.
    I am now trying to get the original DOV copy
    ​​​ returned by the HMRC, however I'm not sure where to try and who to talk to.
    I've requested it via the public records site, but they have only provided a digital copy of the LOA and not any detail of the DOV.
    Could anyone please let me know how i can get the original copy of DOV returned?

    Did HMRC ask you to send them the original DOV?
    IHT 400 Page 1 in bold "Please do not send original documents, only send us copies." IHT 400 Guidance Notes state original documents should be retained by the executor
    "Instruments of variation" on page 9 of the notes only states IHT 400 should be completed to show the effect of the variation on IHT.
    You could try phoning the IHT helpline to ask if the original DOV can be returned

      Hi, many thanks for the reply, you are completely correct, and it was a mistake to send the original DOV through. We are trying to contact them , but so far not luck. I guess one option would be to recreate the DOV with same signatures and dates....it's possible as all parties have agreed to do this if we don't have any luck with HMRC..

        I spoke to the support line, and they said that once the DOV had been scanned it would have been returned to us. However we never did receive it back. They then said that it would probably have been lost....

          You can either:
          ask HMRC if they will kindly print and post a copy of the scanned document or email it
          or
          hopefully a beneficiary (or solicitor) kept the DOV document as a computer file. Print this document again, get the affected beneficiaries to sign it and make a note that the original was lost in the post
