  • Executor not issuing funds to daughter.

    Hi.

    Inheritance based question.

My stepdaughter was named as a beneficiary in a will.

To inherit 10% of the estate.

She was 16 when the family member passed. And one month shy of 18 when probate was granted (probate granted May 2024)

The grant of probate was for £282352 Net.
    I believe 10% would make it £28235.20.

However the executor and sole trustee ( her father) has hidden the will from her saying she has £10000 and only when she's 21 or 25.

She has now got a copy of the Will online and probate and seen it states when she turns 18 she is entitled to her share.

However he has express power of advancement written in the will.

She has told him she has seen the will and now been told the probate is incorrect and she has inherited 18000, however he has been taking money out for things she has asked for including driving lessons before probate was granted.

He still won't give her a figure, a breakdown, an explanation of the incorrect probate, nor will he issue her any of the funds.

    My questions are.

    1. Can he withold her inheritance or should it be paid immediately as the other five beneficiarys have been paid already?

    2. Can he advance payments before probate had passed while she was 16/17?

    3. Can he decide she isn't due until 21 or 25 years old her inheritance when the will states 18.

    4. Can he dictate what and how she spends the inheritance and if he deems it appropriate will release some funds ( she is 18.5 years old)

    5. Can the grant of probate figure be incorrect?

    Thanks all in advance.
