  • Contentious probate - can a solicitor take the responsibility completely of my hands?

    Hi. I've posted before about the situation re my mum's insolvent estate, and my unwittingly intermeddling after the executors (wisely, as it turns out) renounced.

    As I now can't walk away and let the major creditor take their own steps to court, obviously I need legal help. This whole situation, which has a massive back story, has really affected my mental health, and I'm beyond stressed about where we go from here.

    I'm hoping that there's enough in the estate to pay for a solicitor to take it over, but how much can I expect from then? Will I be able to just hand over all the documents, and not have to think about it any more? Or will their role in it be limited?

    I've had an initial conversation with a solicitor and customer care letter, but I haven't instructed him any further. He's very slow to respond and hasn't answered my question about how much I'd need to be involved, so I thought I'd ask here.

      I think the answer is that you need to find a solicitor in whom you have confidence, and then discuss and agree with him/her exactly what you would like him/her to do for you. This discussion should also include cost: you can set a limit on fees not to be exceeded without your agreement.
