  • Where to apply for Grant first

Any guidance from members would be appreciated.

If resident of England had property in England but the resident ends up abroad and does not come back to England then dies, where would Probate be applied from?

Properties and bank accounts in two countries and passport holder of both countries; UK and other.

Is there a specific kind of residency test?

    Thanks muchly for any replies.

Unfortunately this is not simple to answer and if there are significant assets and potential taxes in both countries you may need local legal advice in the other country. It depends on the deceased's legal domicile, not residency.

This link discusses some of the issues.
