    Hy just need some help please;
    1] Deceased person Estate does not have enough money in it to pay funeral and direct costs, owed to us.
    2] A credit card debt of deceased can not be paid as no money to cover, [debt passed to Philips & Cohen
    [Note, I have just finished compiling the estate and letter and completed the form P&C sent to me as Executor, highling the total ins and outs and nothing left to pay funeral realted costs outstanding, so therfore cant pay the hefty £5k nearly debt]
    3] I found that Vanquis had a £19 credit to the deceased, he didnt owe them any money - It seems Vanquis have sent this Credit to P&C, do I, contact P&C or let them know that actually the credit should go to us who are owed the funeral related costs, not fully paid by Deceased Estate, or do P&C keep it as part payment of deceased estate, many thanks

    Who were P&C - just glorified debt collectors - acting for?

    Unless there is some link between Vanquis and the CC company which allowed a right of set off Vanquis should have paid the £19 credit to the estate. As executor you ask Vanquis to pay you. They can't use having paid it to P&C as an excuse not to pay you. If Vanquis paid it to P&C without legal authority it's their problem to get it back. Write and ask them for an explanation and to pay you the £19.

    I appreciate that with an insolvent estate and you the executor personally out of pocket every £ counts, and there's a principle involved, but even so for £19 I'm not sure I could be bothered to spend much time on it.
