  • Keep entering caveats?

    Hello
    I am helping my friend. She is sole executor on her late father’s will.
    A step-son and step-grandchild to her late father have both entered caveats which her solicitor has served warnings on.
    Can other potentially interested people, mentioned in a previous will, keep entering caveats, that she will have to keep warning off?

    She’s getting to the end of her tether!

    Over 18 and with an interest in the estate, a person can enter a caveat
    After the caveator receives a warning letter they have 14 days to make an appearance or the caveat is withdrawn
    Making an appearance is a big step as it can lead to expensive legal costs

      Thank you PEZZA54. Can other people keep on entering caveats? I think my friend is concerned that all the beneficiaries mentioned in the previous will are going to each enter a caveat, in turn, that she will then have to warn off - delaying probate, and adding to my friends legal costs. There doesn’t seem to be any way of ending this unreasonable behaviour.

        Your friend should be more worried about an appearance being made. If the Probate Registry accepts the reasons for the appearance the caveat will be sealed and made permanent. It can then only be removed by consent or court order
