  • Why Private & Confidential?

    Will validity challenge

Witness to Will gets a questionnaire from lawyers marked private abd confidential... But why mark it so?

Does the witness have to keep quiet about the questionnaire? Can they seek advice? So they have to answer?

Can the Q&As be used in court regardless?

It is the witness's answers that should be private and confidential. The witness should make sure when the form is returned the envelope is addressed personally to the solicitor involved and the envelope marked "Private and Confidential"
The witness should contact their solicitor to make sure the answers provided on the form are not available to the public
