  • As a Coexecutor should a Solicitor keep me advised.

    My BIL died last September leaving a complicated estate and myself and his solicitor as executors.
    I decided to let the solicitor deal with probate etc as things are rather complicated and thought that he would be able to deal with things far quicker than myself.
    Having agreed the above I have passed over all paperwork that I had by the end of September 2023, since then I have heard nothing, should the solicitor keep me updated from time to time?
    As far as I'm aware probate has not been applied for yet!
    Any thoughts please as I have no idea what the correct procedure should be.

    When you say you left it to the solicitor, do you mean that you have not taken up the role of executor in the application for probate?

        HELP

        I have tried phoning this firm 4 times and just get told that the person dealing with my BIL affairs will ring me back, surprise, surprise nothing.
        I'm at my wits end with all of this, should I perhaps instruct my own solicitor to see if he can get a reply from this firm, all I want to know is what, if any progress has been made in the past 10 months.

          Perhaps phone again and ask them about their complaints procedure as you’re minded to raise a formal complaint about the lack of communication. It may prompt a response. If not, you can then follow through with a formal complaint.

            Ask a beneficiary to apply to the Probate Registry for inventory and account. This involves the preparation of a summons and supporting affidavit.
            You should explain to the beneficiary why you asking. He or she might think it strange that you as an executor want to receive a summons
