  • Wife wants to leave home to her son ..

My wife has recently made up with her estranged son and wants to leave her house to him in her will although allow me to continue
to live here if I survive her. We live there together and have been together for 32 years, married for the last 9.

She is concerned that if she dies I will meet someone else and they will get her home when I croak, so denying her son anything.

I have no children to leave anything to, so it would go to him anyway.

Is there a provision by way of a Trust of similar to cover the scenario where I continue to live in the house if she dies first and the
house then goes to her son?

Is the house in your wife's sole name at present?
Have you contributed to the upkeep of the house, or paid towards improvements in the last 32 years?

It is important that you both contact a solicitor experienced with will writing and trusts to draft your wife's new will
Over the years you will have gained an equitable interest in the property even though you are not the legal owner.
A solicitor should be able to calculate what % of the value of the property you now own.

Hopefully with your wife's agreement, the solicitor will change sole ownership of the property to tenants in common with unequal shares if necessary

You could then make a will yourself leaving your share to your wife if you predecease her, her son or whoever if you don't

If your wife predeceases you, you may need your share in the equity to move elsewhere, pay care home fees or just have a world cruise
