  • Can my Son Live In The Property?

    Hello,

    Currently we are in the probate process, we have had issues with family members logging a caveat as they feel they are entitled to more than is declared in the will. I am the sole executor and trustee but my niece and nephew are beneficiaries in the will. As this caveat situation could go on for a long time I don't like the thought of the property being left unattended. Would my son be able to move into the property on a short term basis to look after the property? He wouldn't be paying rent etc. but would cover the cost of the running of the house, including the home insurance etc.

    If this is acceptable, would I need written confirmation from the beneficiaries to do so or as I am the sole executor and trustee would I be able to make this decision while we're at a standstill with the caveat?

    Your grandfather's will is being contested and has a caveat on it and now your uncle's will is also being contested with a caveat?

      I don't think the OP says whose estate is under discussion in this thread.

      As executor, you have a high degree of decision making power. But those with whom you are in dispute may in due course argue that you should have charged rent and should make up that sum.
