  • Is it time to involve the Police!

    So without my knowledge in 2019 my mother took on the duty of administrator of my late fathers estate (Value 1.65 million), I am the eldest of three siblings.

    My father died suddenly in 2018 and for over two years my mother (administrator) misled myself and my youngest sibling into believing there was a will left by my late father however it transpired he had in fact died intestate!

    The administrator in this time had been a very busy bee indeed, and by the time we become a wear of our situation she had already formed a deed of variation and photo copied our signatures onto it, sold the majority of the estate assets, took out a mortgage against the estate in my late fathers name and is now using his personal bank account to make payments to said mortgage..

    I also became very suspicious of my middle sibling who since my fathers death has suddenly become very wealthy over the last few years? and now has property and land worth over £300,000 with no mortgage, drives a £100,000 sport cars and is on his 3rd luxury holiday this year, and his proportion of the Estate is far greater than the other two siblings?

    Obviously I confronted my mother about everything who basically informed me that she could do whatever she wants as she was the administrator and her words were "like it or lump it" !

    I informed her I would be involving a solicitor and she replied there is nothing you can do as once the deed of variation passes two years it is non revocable.. and you can't prove anything.

    I did indeed instruct a solicitor and we agreed as the administrator was my mother we should put everything to one side and try and negotiate over the deed of variation to achieve a satisfactory outcome.

    However we have tried negotiating with the administrator (my mother) who has refused to agree with anything as it's not what she wants!

    And instead is making the situation more and more complicated, and now despite repeated requests not to distribute the estate until agreement or court order has instead registered the entire estate into her name via land registry and has continued to distribute her and my middle siblings share of the estate and refuse to negotiate with the other two siblings.

    It now turns out my middle sibling was in on the whole thing.. and was the only sibling who knew from day one that my father died intestate other than my mother.

    My mother (administrator) is computer illiterate without even as much as an email address and it transpires the middle sibling has been heavily involved in ALL the dealing of my late fathers estate since day one, which now makes all his new found wealth make sense, now I have also found out that the mortgage taken out against the estate was used to purchase property and land in the names of the administrator and middle sibling, this is outside of the middle siblings share of the estate.

    To start off I agreed with my wife that it would be immoral to involve the Police as after all the administrator is my mother and we have five children, her grandchildren, how would it look to them?

    However my mother has now started a hate campaign against my entire family to try and discredit me so as to make people believe I am some ungrateful child with a waste of space wife and five useless children!

    So here I am getting nowhere, running up massive legal bills and feeling the only way forward is to involve the police?

    However my solicitor has pointed out that we have no real evidence.. however I feel we have enough to start?

    I can show the following...

    The deed of variation was formed between the administrator and her solicitor directly after my fathers death.

    Land registry showing the purchase of land including owners.

    There is also three deeds of variation? a draft copy and a final copy which is different from the draft copy?

    However more alarming a copy supplied to my solicitor from the administrators solicitor with no addresses that has inheritance due to the youngest sibling in the draft and final copy of the deed of variation now in the name of the administrator.

    And the administrator has also admitted that the eldest and youngest sibling did not see the deed of variation as she claims due to COVID she did not have to provide one?!

          As you have been defrauded out of your inheritance you should consult a solicitor that specialises in civil fraud.
