  • Solicitors practice closing

    Hi,

In 2014 my then solicitors dealt with my Declaration of Trust.
In 2015 the same solicitors prepared my Will.

I have been informed that this solicitor is now closing it's business and all their details are being transferred to another solicitors practise. The old solicitors where my Executers.

The new practice have now written too me saying I need to sign a codicil for them to act for me before 31st October 2023.

Will I need to have to pay any costs in this or too what is my current position?

Do you still want the solicitors to be your Executor?

Either way you will need to do a Codicil to change the Executors of your Will. I'd expect the new solicitors to charge for it but they might do it for free if you are appointing them, as they'd expect to get fees from acting as your executor in the future. Ask them and see what they say.

The cost should be pretty small though. A Codicil to change executor is a short standard form document, they don't have to draft it from scratch, and it's not going to cost them much to send it to you. Or if they are nearby pop in and do it in their office. Should only take a few minutes.
All opinions expressed are based on my personal experience. I am not a lawyer and do not hold any legal qualifications.

Have you asked the solicitors that question?

Beyond that, it seems to me that as it is for their benefit, you should not have to pay.

Why do you need a professional firm to act as executors? Are your affairs and wishes that complicated?
