    Good morning,

    We are involved in a dispute and want to communicate with the caveator (through email) to discuss the matter further, with the hope of coming to a settlement.

    At the top of our communications, would it be better to use "without prejudice" or "without prejudice save as to costs"?

    WPSAC contains an element of threat in respect of legal costs if the case goes further. WP does not have those connotations.

        I had problems with a caveator but had no idea about these terms. So whenever I wrote, he never replied to correspondence anyway. I did say in the letter that since he had raised the caveat (s) he would be responsible for any legal costs incurred and I stuck to that and deducted them from his share when I finalised the estate accounts.
