  • Memorandum of appropriation

    We have the above signed by the executors regarding the house which has now been sold does this mean we are entitled to the money even though probate is not done

        Basically it says the house no longer has anything to do with the estate

          Any more detail? We do not presently have any information to enable us to hazard a guess as to the answer to your question. Why not ask the executors if they are in a position to make a distribution, and if they are not, when they will be?

            1. GIVE NOTICE to the Beneficiaries that we have this day appropriated the Testator's interest in the Property specified in the schedule hereto

            2. DECLARE that as from the date hereof we hold the Testator's interest in the Property as bare trustee for the Beneficiaries in equal shares and not as personal representatives of the Testator.

              ok, but that tells us nothing about the executors' ability to distribute money. See my previous reply.
