    Hoping someone can advise, I am the executor of a will the sole beneficiary has advised me that they do not wish to receive any part of the estate.

    A brief background the estate was contested which took a long time however we now have probate. As the beneficiary has now informed me that they want no part of the estate, where does this leave me as a executor.

    As the will stands if the beneficiary died then the will states that the estate would pass to the said executors. However as mentioned the beneficiary is alive but does not want to receive it.

    Does anyone have any idea as to what the proceedings would be in this instance.

    You could try asking this beneficiary what he wants done with the estate - are there other family members etc. For your protection you should get any such direction properly documented. I think that your solicitor's fees can be a proper expense of the estate.
