  • Names on LPA

    I am in the process of setting up lasting power of attorney for my parents. I used the gov.uk service, where you fill out the forms online, pay and submit, then print off for signing. Most of the signing is now done, but I realised too late that I hadn't put in middle names for anybody - donors and attorneys - just first and last names. Does this matter? Would it invalidate the agreements?

    I can see three options at the moment:
    1. Send in the forms as is.
    2. Correct them and initial the changes (but there would be quite a few changes).
    3. Redo from the start (which for various reasons I'd much rather not do).

    Any advice very welcome!

    Sid you manage to find the answer, I wanted to know if it mattered on a will too, especially a parents will?

      I'm not sure about a Power of Attorney (I have some questions about those too) but the important thing with a Will is to positively identify the parties. Full names are preferable but two or more people could have exactly the same names. Other identifying features help such as address at a given time, relationship to one or more of the other parrties. Really anything that makes it clear than person X is the one referred to. A relative named me as his exector but gave me a miiddle name, that I'd dropped years ago. None of my current ID shows that middle name but other factors made it clear I was the person he intended to appoint.

        Are you allowed to fill out the for LPA on your parents behalf,
        o thought the donors had to do it themselves otherwise classed as no mental capacity and therefore unable to apply for LPA?

          Yes. Obviously the donor has to sign in all the appropriate sections.
