    Hi good to be on line to ask for guidance with a heartbreaking story.

    Mum passed and was cremated, i was informed weeks after the event, no family members or dear friends were informed .
    No funeral just a non attended cremation .A funeral plan was cashed in, another cheaper funeral plan was opened and again cashed in, the cost of which came from mums account but refunded to the family members bank account and this was done the day before mum passed.
    Before mum succumbed to Alzheimer's we had discussed her wishes in full and as executor I would have implemented her wishes, I was denied to carry out this last duty for mum.
    I only found out because a e- mail from family member informed me stating I now had to deal with certain department who had adult care of mum and monies need to be released to beneficiaries.
    After investigation i found out family member had closed all mums bank accounts, and tried to get probate to recover money from adult protection department, who refused because they knew there was a will.
    Family member also knew there was a will and I was sole executor.
    The will was clear that any monies were to be equal split.
    I have requested full disclosure of all bank details.
    The family member refuses to respond to many letters sent, registered and e-mails by solicitor and myself.
    i have requested statements from the banks , one of which so far has not provided and insists family member had the right to close the account.
    Another bank has provided details, and the account shows many high cash withdraws and excessive expenditure.

    Mum was diagnosed not capable due to Alzheimer's, and court of protection awarded all assets and bank accounts to the adult protection.
    All bank accounts were requested to be handed over.
    3 bank accounts were not given to the adult care department a private pension mum had was placed into these accounts and has been withdrawn in cash lumps, when mum was in full time care in a nursing home.The cost of which was fully covered by the adult care finance department.
    The family member tried to approach the pension provider to claim the closing balance but was unsuccessful as the closing amount was sent to the solicitor
    The department of adult care had no knowledge of these monies in these accounts so the extra funds could not be used towards mums costs in care.
    We are still trying to contact the family member, I have approached the police but alas they do not see any issue that is within their power to act.
    any advise would be appreciated,
    The other beneficiary must also await for an inheritance which is now tied to the non cooperation of the other beneficiary.
