  • Selling Property after Death - Purchaser Wants To Rent it First

    I'm dealing with my late mother's estate as executor, we are selling the property and have an offer. The prospective purchaser wants to rent the property whilst probate is finalized.

    Should I be concerned about this?

    Secondly, we received this email on Monday 19th of September 2022 - It all seems a bit rushed, but I would appreciate other people's take on things, please.

    I hope you’ve had a lovely weekend and bank holiday.

    I just wanted to send an email to catch up with you / make a plan.

    The home buyers survey is booked in for Friday 30th Sept and I should have the survey back on Monday 3rd October.

    I’d like to plan with the sellers that I move in on either Tuesday 4th Oct or Weds 5th Oct.

    So before this date / as soon as possible we need:

    1. The rental contract to be drawn up and signed etc.
    2. We can both start the buying / selling contracts with our solicitors - including the 2-way “lock-out clause” where we both put in 20k and potentially lose that if either of us pulls out. Money to be held by the solicitors for both parties.
    3. Please can I request that all furniture/items are completely removed by Tues 4th Oct. (If there is anything they don’t want, like the round stone kitchen table I am happy for that to be left, anything else maybe they can let me know?) Otherwise for the house to be completely empty.
    4. Please can the seller arrange for the whole house/carpets/windows etc all to be deep cleaned, an end of tenancy deep clean, before the 4th October.

    Hopefully this is all ok with the seller. Please can you let me know.

    As soon as the rental start date / rental contract has been agreed I can book my movers to deliver all my furniture etc to the house.

    If you haven't got probate yet, no.
    Ask your solicitor who will know much more about where everything is.

      He's a bit pushy, isn't he?
