Do all beneficiaries have to agree to take it to court?

If you are talking about a claim under the Inheritance (Provision for Family and dependants) Act 1975 it is most unlikely that beneficiaries will support the claim as they stand to lose part of their legacies.
If the beneficiaries agree you should share in the estate the way forward is via a variation.
