  • Car given as gift by dying man?

    Good afternoon

    I hope this is in the right forum

    My next door neighbour, who i have been looking after recently, has just given me his car, told me to fill logbook out and keep the car

    He is basically dying , has no family that i am aware of and cannot use the car anyway

    If i accept is there any possible repercussions on me?

    **UPDATE **

    He has just passed away and when he called me into hospital the nurse asked me to take his logbook in and he gave me the green slip

    I now have a number of additional issues as his next of kin how do i go about sorting all his business out?

    Can i look into all his banking to find if funeral plans etc?

    What are my boundaries legally?

      Condolences on the passing of your neighbour.

      The title "next of kin " has no legal meaning and doesn't give you the right to sort out his affairs.

      Do you know if he left a will, and if so can you locate it?
      If you know details of his bank account(s) it would be a good idea to advise the bank(s) of his passing.

      If there is no will, and you are not related to this gentleman, you cannot obtain letters of administration, nor inherit.

      As he gave you his vehicle before passing away, depending on its value as a gift, it will need to be declared to who ever sorts out his estate.

      You can arrange the funeral, and register the death.
      If there are sufficient funds in his bank account, the bank should pay the funeral director.

        Thanks for reply

        However, i believe he literally has nobody else, no family or friends

        He told the hospital the same

        He only has a few hundred in the bank so not enough there

        the car is probably worth £1k

        i feel obliged to sort things for him though

          You might feel obliged to do so, but you have no legal standing to do so and should not.

          If you arrange the funeral and there are insufficient funds to pay for it, you could find yourself liable for the cost.

              My Brother was faced with this problem indirectly, The local Vicar paid visits to the patients in Hospital, he was asked to sign for a funeral, he was not aware the funeral was now his responsibility, my Brother and a friend chipped in and paid, many years ago now but a lesson in life.
