  • Inheritance entitlement?

Should I pursue any entitlement, from my Dad's estate, to which I may be due?

My Dad died in 2012, he was estranged from his wife at that time. He had remarried approximately 20 years previously.

His wife already had a solicitor, the partner of a prominent Edinburgh law firm, who administered her six figure inheritance. I know there is zero entitlement to that, of course.

My concern is that when my Dad and his wife made their (possibly mirror) wills they drew them up with same firm.

The 'understanding' being he would have no claim on her inheritance, (which I personally know was never a possibility anyway) if she in turn would ensure that his 4 children (of which I am one) would inherit equally, his half share of his home once sold or after her death.

Whilst estranged, as my Dad was poorly, the eldest child was granted power of attorney both financial and medical. A bank account was opened jointly by the eldest and my Dad. On his death, there was some money therein which two of his children shared.

I have now been notified that my Dad's former marital home was sold in September 2021.

Would any of his children be entitled to receive any benefit from this sale?

I would be hugely grateful if any of the legal beagles would kindly advise.

    Many thanks

      England or Scotland?
Have you a copy of your father's will?
The manner of recording wills and cost of search of records is different between England & Scotland
If recorded you can obtain it here https://www.mygov.scot/finding-will

Scottish inheritance laws are quite different to those of England & Wales, so might not be of much help

It's Scotland, I don't have a copy of his will as yet, think I will have to make an application through the RoS. Many thanks for your time though DES8
