  • Executor/beneficiary wants valuable asset not in Will

    Three beneficiaries to a will. The will states the estate is to be shared amongst the three beneficiaries after all debts paid.

    Deceased had a personal loan for £5k and an asset, a car, worth £20k. The car is not mentioned in the will.

    One beneficiary claims the deceased promised her the car, if they paid of the personal loan, when they were alive. The beneficiary didn't want the car when the deceased was alive.

    The beneficiary also an executor now wants to pay off the personal loan of £5k and take ownership of the car. The other two beneficiaries feel this is wrong and/or illegal. Please advise.

    Note, application for probate hasn't started yet.
