Probate property 1 sibling wants to continue living in the property rent free.
The property will be divided unequally between 4 siblings- it has not yet been registered with the Land Registry
5/8ths to brother currently living in the property- (I believe his income to be approx £80 per week )
1/8th each to myself & two other siblings
We - myself and two other siblings have suggested that the brother can live in the property for two years & then it would need to be sold.
- Hie has said I am being unreasonable & he wouldn't be able to move for at least 3 years as he is still grieving. It has been approx 11 months since the relative died & not all the monetary assets have been dealt with by the solicitor as originally agreed so alarm bells are starting to ring.
If we can all agree on him remaining in the property for a fixed period of two years who is responsible for
House insurance
Utility bills
Council tax
Maintenance & repairs to the property
Is it considered a residential let & therefore requires electrical safety certificate, gas safety certificates, EPC ect . The property has polystyrene ceiling tiles
Does the Joint and Several Liability mean that if no one else pays I am liable
I have suggested we look at having a contract drawn up but f he refused to move would he/ we have any legal rights.
