It looks like I may have to apply for a court summons to get a permanent caveat removed as the caveator is refusing all contact with me but has told my solicitor in a very spiteful email she is going to make an appearance. She already has an equal share of the estate so there is no financial gain for her. The solicitor said I will have no choice but to apply to the Court for a summons. That will then involve a hearing being listed where a Judge will ask her to explain why she wishes to maintain her caveat and whether she wishes to issue a probate claim. Can anyone explain this process to me? I have already spent £3k and got nowhere - she is unemployed and has spent nothing other than £20 on the caveat and presumably the postage cost to send the appearance to Leeds. It seems so unfair that someone with no money can get this far and completely screw up probate forcing me to take action and spend the estate money. My solicitor says several thousand pounds just to get to the hearing.
