  • Joint Executor Problems

    Hello,

    A family member died this year and he left a family member and myself as joint Executors.

    The other Executor has decided to stop all communication with me and has all the documentation including finances.

    I have no visual sight of what is happening, so the beneficiaries and I are concerned with what the other Executor may be doing or not doing.

    I have written to the other joint Executor and asked them to send me all copies of the estate, finances and financial transactions by a reasonable date to allow them to make copies.

    However, If they do not open communication or provide the copies, I'm unsure what to do next.

    Before the breakdown in communication, I believe they may have started the process for probate. I am worried that they will do something unethical or illegal such as direct money out of the estate to themselves.

    I would appreciate any advice on how to approach the situation, or how to find out if they are acting independently without me.

    Do you have a copy of the will naming the executors?

    If the other executor is applying for probate he will have problems if you are left out.
    Look at section 3.6 of the application form PA1P (https://assets.publishing.service.go...2/pa1p-eng.pdf)

    If you are still unhappy you could lodge a caveat. Cost £20, lasts 6 months and stops any probate application (https://www.gov.uk/stop-probate-application)
