  • Probate solicitor or do it myself?

    Hi, my partners nan recently passed away without a will.
    Her daughter is still alive so I presume she will simply be awarded the estate however I believe that we will need to go to probate to achieve this?
    Is this a simple process or would it be advisable to employ a probate solicitor to oversee it?

    If the deceased does not have a living husband or civil partner, her estate will pass to her children.
    As there is no will letters of administration may be required.
    It will depend on whether or not her estate includes real property, or stocks and/or shares, or how large.

    Sounds simple, but beware those who might come out of the woodwork looking for a share under
    the Inheritance(Provision for Family and Dependents) Act 1975
