  • Family Will Trust (Settled Land Act) and selling the house

    Can anyone advise on breaking a Will Trust early and selling the house of the Life Tenant?

    A much loved family member is sadly incapacitated with Alzheimer's and in care. Her family have Power of Attorney, Property & Financial only. The house has been empty 18 months. Do we need to apply to the Court of Protection to sell it and how likely is this to be successful? The Life Tenant already has her care financially guaranteed and the house is deteriorating fast.

    Would love some advice. Please.
