  • Who owns the house legally speaking?

    Hello,

    My grandparents estate was signed over to my mother many years ago, so she legally owned the house. However, my mother unfortunately passed away 4 years ago.¬*

    Who legally speaking now owns the house? Does it default back to my grandparents, or would it default to the grandchildren?

      She will have done yeah, i think all of her estate was passed to her husband (my father). I do need to double check that however.

          The house is part of your mother's estate
          No will...If there are surviving children, grandchildren or great grandchildren of the person who died and the estate is valued at more than £250,000, the spouse will inherit:
          • all the personal property and belongings of the person who has died, and
          • the first £250,000 of the estate, and
          • half of the remaining estate
          .

            So in my case, assuming the house is worth 400k:

            -My father inherits 250k + 75k = 325k
            -Children inherit 75k¬*
