  • Wills and step children

    Please can someone advise me
i need to make a will but I’m concerned how I write this as I have a daughter from a previous marriage I have now remarried and have 4 stepchildren
i will be inheritating my parents estate when they pass away and I want to leave any money to my step children but only to my daughter
the problem I have is that I want to leave everything to my husband if I die first but how can I protect the money from my inheritance not going to his 4 children
I feel this is right as it’s my parents money and we have property which can be split to the 5 children but how do I word a will

To get it right you would need to visit a solicitor for help but basically you would leave part of your estate to your daughter but leave your husband a life interest in it ( if it is used to pay for the property you own etc ) with conditions on remarriage, sale of the property and so on, otherwise leave specific sums to your stepchildren and husband with the residual estate going to your daughter. This is quite a common situation so talking over the options with a solicitor will ensure your will properly reflects what you want to happen and cause a great deal less stress for your family when the time comes. It is unlikely that you receive your inheritance from your parents and simply put it aside or in trust to go to your daughter, you could of course do that so there is a defined, separate sum specifically from your inheritance from your parents to go to your daughter, but in reality that doesn't tend to happen.

Presumably you have discussed options with your husband and what happens should he pass away before you regarding the property, your daughter and his children too.

You can as well, ask your parents to put your inheritance into a trust so that you have the benefit of it but it then goes to your daughter. This is what happened to me (or sort of) . The inheritance goes into a trust and on my death is split between my own children and not my step children. This was done a while ago so things may have changed .
