  • Power of Attorney vs Will

    Hi guys, I hope you're all well. I have a troubling issue that I hope someone can clear up for me.

    The family home is mortgage free and in my dad's name. He's told me and my brother that he's made a will whereby if we sell the house once he leaves us, we will receive 50-50 of the sale proceeds. We are both happy with this.

    The problem that's arisen now is that my brother has been diagnosed with MS recently, and he's beginning to struggle from a mental capacity. Another family member is caring for my brother and suggests he should be given Power of Attorney to handle my brothers affairs when he's unable to do things for himself.

    Can somebody tell me if this POA arrangement will cause complications with my father's house? Specifically, if both my father and brother depart, could this other family member lay claim to my brother's 50% share of the house?

    ​​​​​​​It's really upsetting talking about this but I have to face facts.
