We have received the sealed warning from the Probate Registry with an accompanying letter which says it is now for us to serve this upon the Caveator. I thought that this form now had to be witnessed by a solicitor before sending to Caveator but the letter says nothing about this. Can anyone verify this, please? Thank you.

Hi Thatsamore,
Once the warning has been sealed it needs to be served on the caveator. The caveator then has 14 days in which to respond.
You would have signed the warning form before providing it to the Probate Registry/ Court. The Registry should then check the person requesting the warning has sufficient interest in having the caveat removed ie they are an executor or beneficiary requiring probate for example.
You would have given an indication of whether you were acting in person or had solicitors acting for you on the warning form.
Once the form is sealed by the Probate Registry it must be served there is no further requirement for signing again.I am a qualified solicitor and am happy to try and assist informally, where needed.
