In 2008 my father put me on the deeds of his house as tenants in common. In 2009 he remarried. My father died 2016. His Will left his half to me and elder brother. So tried to do probate and she put caveat. Tried to enter the house and found she had changed the locks.
2 years now back and forth with solicitors, going to mediation. My elder brother been dealing with all this, so been quite difficult asking him to ask questions to the solicitor.
Solicitor says do mediation as if an agreement is made we will be done. If mediation fails then go to court and even if we win she can go down the provisions act 1975 and continue in the house and we continue fighting and could be another 2 years. We've spent almost £20k on this so far.
With my name on the deeds I thought at least we could be demanding she pay rent or buy me out or at least I'm allowed access, still got a couple of things there that are mine. But the solicitor said we can't do anything, not even go there as she may have a camera and tell the court we were harassing her.
I was paying the telephone bill even after I moved out and took over the other bills when my father died, but once she changed the locks I cancelled it all, so that she would have to pay.
She could possibly be renting out rooms at the house, is that legal?
