    Hi ! can the sole beneficiary (spouse) of a will make a PPI claim for a deceased husband the PPI was in the husbands name only,the spouse is not a Executor. I'm a Executor but it seems like I cant claim as the other Executor does not want to claim as any money sent will effect her financial standing. A claim firm sent out claims packs to both executors to sign. The deceased account is still live as it was a joint account but his name as been taken off with just the spouses name. There is no grant of probate as all assets went to the deceases spouse.
    There is a few single premium polices of PPi one was for 5 years taken out 6 months before he was 65 which I believe is mis-sold. regards

    That's not an option. Executors have to administer the estate and have a fiduciary duty to the beneficiaries, in this case what we call the 'residuary beneficiaries' because they get what's left after all the specific bequests have been dealt with. The beneficiaries can claim against the executors for failure to take steps which would have increased the assets in the estate. The only exception would be if she were the only residuary beneficiary.
