Can a next of kin make a claim for compensation for an elderly relative deceased following accident despite not being a named executor or beneficiary on the will or if compensation is awarded would it go to the estate

If the deceased left a will the executors can bring a claim, any award becomes part of the estate.
If the deceased died intestate the nearest relative as set out by s.46 of the Administration of Estates Act 1945 can bring a claim, and apply for letters of administration to deal with the estate and any damages awarded
