  • Foreign/Cross Border Probate Question

    Hi all - hoping someone with some knowledge of Chinese/Hong Kong law might be able to shed some light on this...

    A will made in Hong Kong by a joint UK/Hong Kong citizen left a third of his estate to a legatee I know. One part of the estate is a residential property inside China. Is the Hong Kong will valid in China? The parts of the estate outside China have been settled and disbursement’s made already but the property inside China hasn’t yet been sold.

    If the Hong Kong will is valid in China, what kind of steps should the legatee be making to begin the sale of the property? Thanks a lot for any insight.

      Hi,
      As Mike770 said we only deal with Eng/Wales law I'm afraid. You will need to get some specialist advice on this from a solicitor in HK /China law and whether there are any specific succession rules for example. Maybe, if a lawyer prepared the Will in Hong Kong, contact them as a first stop?
