  • Deed of Variation alternative beneficiaries

    A basic question relating to the person or persons who become beneficiaries as a result of being named in a deed of Variation.
    The original beneficiary of the residuary estate names another person to receive their share of the estate. Does this new beneficiary have the same rights as a residuary beneficiary to the estate accounts and the right to stop the distribution of the estate by not signing off the estate accounts?

      Hi and welcome.
      I think ( [MENTION=85500]Peridot[/MENTION] will confirm or deny this!) that a residuary beneficiary created by a deed of variation, has all the rights of the original beneficiary.

      However no one can stop the distribution of the estate by not signing off the estate accounts.
      The "signing off" is just so the executor can point to the agreement if a dispute arises later.
      It is not mandatory and the executor can distribute without obtaining signed agreements
