    Hi there

    I am looking for some help please. I was contacted by Vodafone before Christmas unsolicited to try and get me to go on a contract with them. They offered a Nokia Lumia 520 windows phone as part of the upgrade. I decided I would try it and see but at the time I was very ill (I am disabled!) and only got that it would cost me £13 a month including the phone. When the phone arrived I had great difficulty trying to get the back off to put in the battery, sim and charge it up. I used it for a couple of days and hated it. I couldnt understand it at all. I called vodafone and told them this and asked if I could cancel but the person told me I couldn't because I had used the phone. I thought then I would just carry on and see if I got the hang of it. I didn't! In the middle of January I decided to go back to my old phone and give the new phone to my friend. I contacted vodafone and they arranged for a new sim to be sent out for my old phone. I tried to open the back up of the Nokia to take out the sim and return it to factory settings for my friend and the screen cracked. The phone was useless because it's touch screen.

    At that time I had to phone vodafone to activate my new sim and I told them about this. They said I had to take it to the nearest vodafone shop and they would decide whether I get a new phone or they send it back to be repaired. At that time they were supposed to activate my new sim...and it wasn't done. I had to call them again to activate the sim and I asked the same question to the new Customer Service person as the first had clearly not done his job properly and I thought he may have had that wrong too. The second person said the same thing.

    I haven't been at all well since then and, as said above, I am disabled. I haven't been able to get into the shop and, quite frankly, I feel that if somebody is selling you something over the phone, you should be able to send it back via the postal service rather than take it into a shop. The absolve themselves of any responsibility and make it very difficult for the customer to return the product. I wasn't able to see the product being used and therefore didn't know what phone was coming before it arrived...apart from a little marketing info online.

    I now have a phone that I am paying for via a contract...that doesnt work...and I have found online that this is quite a common problem that is not being recognised by Nokia.

    To add insult to injury I have received no correspondence relating to my new sim, have received no payment date for the dd to come out my account and tonight when I tried to call them to see why my phone has been restricted, I can't get through either via phone or online chat. I really am feeling very disgruntled...and feel I have been ripped off big time.

    Do distance selling regulations apply and should they take the phone back and give me a new one? They are refusing to do this and the phone is effectively useless. I can do nothing about it unless I can get in to the shop, which is very difficult for me due to my circumstances.

      Hi Puppy, sorry its taken me a while, I work in the mobile industry and to be quite honest I am VERY concerned about what you have told me.

      With regard to the distance selling, with the company I work for (not Vodaphone) has a policy of a 14 day return on any contract taken out over the phone and internet, but not via store.

      Swapping a sim, well that's something I do every day, takes 24 hours tops.
      I would call up and demand a manager and a full explanation of what has taken the time, as it is simply a service failure.

      The cracked screen, well.. that's opening a whole new can of worms!
      If you have no insurance on your account, you WILL NOT get a new phone. Basically, the screen of a phone is not covered by warranty.

      And as unscrupulous people, and I hasten to add that I do not class you amongst the "Dodgy Bugger" collective, have been claiming the screen on warranty and they have broken the screen by dropping it etc we are now told, no insurance, no replacement.

      Will look in to this when I get home, sorry if it takes a while but I will be as quick as I can

        Thank you very much for your responses. So I basically just have to bin the phone then because it won't work with the screen cracked as it's a windows phone. I should have been told about distance selling but now of course it's too late. I really feel as if I have been ripped off and I got a letter today from Vodafone...the first I have received....telling me I owe them £23 when I haven't received an account, no letter to advise me of DD date etc., and I couldn't get onto my account to see how much or what was going on....because the website always says we are doing work on it.

        It really is quite shabby for a mobile provider I think. The phone does seem quite fragile to be honest. I thought that when I was using it. My other one is a Galaxy Ace and I like that. Thank goodness I didn't give that away or I would now be phoneless with no customer support etc., :tinysmile_hmm_t2:

              i started a contract with Vodafone one net back in Dec 2012, was supposed to be a 24 month contract but now turned into a 36 month one, but as i am advised 36 months are illegal, back in April 2013 i had my phone stolen and due to no insurance at the time i was completely phone less, when i rang to get the phone blocked and barred they offered to send me out a new sim card, i thought they were joking as i had the phone stolen i couldn't afford their prices to replace it, but no they weren't.
              right from the beginning of the contract i have complained about the 3G reception not working, at first i got told i was not near a mast until they realized i lived very close to one, they sent a new sim each time i rung, (as by this time i had replaced my stolen phone) still even now 18 months later i cannot get 3G at home or most places i have to turn the phone on and off to get it for half hour till its gone.
              i have emailed them, talked on online chat and rang but still no better, now they say i cant even upgrade as my contract runs out on dec 2015 this i cannot understand at all.
              they are the most rubbish company to be with and as soon as i can get out of it i am leaving and never going back, its been the worst contract i have had and the most expensive, i am in financial difficulty's and most of the time default on my dd payment but they will not downgrade my calls ect. if i were you i would run as fast as you can away from vodafone
