  • Bittersweet victory

    6 years ago i worked or Carphone Warehouse. I had worked for them for 3 years with an excellent record. My manager took it upon himself to record me having sex with my boyfriend who he lived with and he then played it to work friends at a works do. I took this to a tribunal and lost. I think due to a less than adequete solicitior.
    I suffered massively from depression from this and dropped to the very depths of despair.

    I built myself back up and a year ago i started to receive letters from CPW for a mobile phone bill from that period which i was unable to pay as i was off due to the tribunal. In all that happened i had forgotten about it until these letters turned up. The debt is 5 years old now.

    The demands were sent from DCA to DCA to DCA eventually today i received a letter from Rossendales. I have never spoken to them before.

    This is what the letter says



    Dear Sir/Madam

    We are writing on behalf of our client Carphone Warehouse in response to the recent query you have made. Our client has instructed us to close your account and not pursue any further collections activity.

    Your account will be returned to Carphone Warehouse, who have advised that they will close your account down and not pursue you for any for any outstanding funds.

    We trust that the matter is now closed.


    I feel so relieved that they have realised this would not benefit them by taking it to court and me dredging up the past and it feels a weight off my mind, it is just sad that this has had to go so far because of some idiot they chose to defend.

    It feels a small victory but in reality it should never have come to this but i will take it for what it is and start afresh.

    Don't let the B*******S grind you down is a saying I use ever so often, then its chin up and prepare for life's next little challenge. Its all part of the learning curve. Regarding the letter stating that your account is closed I'd suggest you keep it somewhere safe in case of future need.

      Sorry to hear about what happened to you, the manager sounds like a right ******* who needs a good kicking for what he did - Did you boyfriend know he was recording you both? Either way recording without your knowlegde of permission i would believe would fall foul of the sexual offence act 2003 as an act of voyeurism under section 67 and if your boyfriend knew about it then he to may have committed an offense under section 62 (i believe) of the sexual offence act 2003. It is also not to late to take the matter to the police as i do not believe their is an limitation period for sex offences. Though it would help if you had witnesses that saw the recording as i doubt you have a copy yourselve - I know i wouldn't want a copy if i had been in your shoes.

      Basically, yes goto the police. Yes your solicitor was an idiot as any solicitor worth his salt could have told you that it was not an employment matter as it happened outside of work, however the showing of the recording should have come under sexual harassment in the work place, which it self is an offense. To be honest i can not see how a tribunal could let this go, but i suppose its too late to do anything about the tribunal discision now. But as i said its not too late to take it to the police to get the jusitice you clearly deserve. We even have a retired policeman here in the name of BlueBottle whom am sure will confirm what i said and beable to provide more advise for you if you choose to take it to the police, which i think you should in order to stop the pervert from doing it again!

        Hi Teaboy, Thanks for your reply. The police just wasn't interested. They said it wasnt against the law but because it was such a long time ago i can't remember the reasoning of this.

        My boyfriend wasn't aware of it and he moved out shortly afterwards.

        It took me a long long time to get over the incident and the decision of the tribunal. I do believe i was wronged in many ways but i have to move on. I believe karma will come back. In there meantime i am stronger for the fight and yesterdays letter to write off my so called debt with them was bittersweet but i must look at it in a good light.

          I'm truly shocked and appalled that this has happened to you, it must have been terrible for you.

          I agree with teaboy2, I think this pervert should be made to pay for his actions, but that has to be your decision and yours alone. If you do decide to take this further, know that we will be here to support and help you every step of the way.
