    EDF are getting on my last nerve.

    After a call to them this week to discuss their ridiculous request for £210pcm for electricity, I was lectured by some no mark that as I'd used the electricity I'd have had to pay for it. HAppy to pay for electricity I use but not at the rate their requesting.

    Long story short I told her unless she moderated her tome, I'd be complaining to OFGEM and moving my account, she said I was free to complain but would not be allowed to move until I'd paid off any arrears.

    Do I have to pay them off or can I move and then deal with their claim for arrears separately

      You will also be allowed to change supplier if you use a prepayment meter and have a debt of up to £100. Your debt will be transferred to your new supplier. For more information about changing your supplier when you have a debt, contact Consumer Direct – see under heading Useful organisations.


      This changes to debt of up to £200.00 in January 2010.

        Well I managed to move to BG whilst still owing £586 to NPower?Powetrgen?Eon or whoever they were/are, Not sure quite how I managed it but I remember it was a sales bloke at the door and I distinctly remember saying yes I'd like to change suppliers but had no chance as we were in debit with our current one. He said well fill the forms in anyway and we'll see what happens. And the rest, as they say, is history........as my Bryan Carter thread testifies lol.

            An update on my wrangle with EDF

            Basics
            1. Moved both gas and electric from BG to EDF via USWitch
            2. Rate agreed (£19pcm for electricity) over the net
            3. It took 7 months for them to calculate that my usage was well over the original £19pcm requested, we agreed a figure of £80, part of which was to pay off the outstanding balance
            4. It was a matter of months when they came back again to ask for more this time £95 to cover usage. None of the monies owed had been payed down in this time.
            5. Finally this year they have requested £150 pcm to pay off what has been accrued and to cover my usage.
            6. I've said I'll pay for my usage which I'm doing @ £105pcm but I am disputing the monies they state are still owed.
            7. Throughout all this I have agreed increases on the grounds that the monies owed are payed down. To date this has never happened - all sums paid has gone to pay for usage.
            8. I've been trying to sort this out by requesting (DPA) copies of all data which they have singularly failed to do.
            9. I've had one letter from their legal department and responded restating my needs and requesting confirmation of their last word so that I can seek guidance from teh Ombudsman, this was in Jun.
            10. This week I received a letter from Richburns threatening entry to either disconnect or install a pre-payment meter they cite 'Rights of Entry (Gas and Electricity Boards) Act 1954' copy attached
            11. I've responded with the stock 'I refuse entry to them and their minions' and a request that should they seek a warrant that I be informed as to when and where this will be heard so that I can put forward a defence.
            12. I've also sent an email to EDF to state that I am reporting this matter to the ombudsman and the OFT for enforcement of a debt whilst in dispute.

            Letter to Richburns

            Dear Authorised Officer

            Thank you for your letter dated 4 Aug 10, the contents of which are noted. Please see the attached letter to you client dated 7 Jun 10 for which I still await a response.

            Until such time as I receive a response to the attached and your client fulfils its responsibilities under the Data Protection Act in regard to my request for all data on all systems pursuant to this matter, I dispute their claim.
            Please note I have received no default notice with regard to this claim and therefore enforcement action is not permitted.

            As holders of a Consumer Credit License you are obliged to comply with the Office of Fair Trading Guidelines on Debt Collection. I remind you of your obligations under Office of Fair Trading guidance 664 for enforcing a debt that is still under investigation.
            As for your right of entry: Under OFT guidance, you can only visit me at my home if you make an appointment and I have no wish to make such an appointment with you.
            There is only an implied license under English Common Law for people to be able to visit me on my property without express permission; the postman and people asking for directions etc (Armstrong v Sheppard & Short Ltd [1959] 2 QB 384. per Lord Evershed M.R.).

            Therefore take note that I revoke license under Common Law for you and/or your representatives to visit me at my property and, if you do so, you will be liable to damages for a tort of trespass and action will be taken, including but not limited police attendance if need be.

            Further if you wish to take the step of obtaining a Warrant I require under Civil Procedure Rules that you inform me by return in which court you will be making this request as I intend to present a defence. Further I will be requesting that the case is allocated to the county court in Cheltenham.

            Please treat this letter as my request made under Civil Procedure Rules 31.14 for the disclosure and the production of all documents you will be relying upon in your threatened request for a warrant.

            I require by return an email to the above address your intentions in this matter.
            No response so far from either organisation. I'm going to raise a complaint with the ombudsman

            Only worry is that they'll obtain a warrant without my knowledge an poll up while I'm not in to do their thing.
