Help needed please.
A 17 year old boy has been alleged to have shoulder barged a 16 year old girl at school, which has resulted in an assault complaint,
The girl in question has been relentlessly bullying the girlfriend of the boy in question, but only when the boy is not present, to ensure no witnesses.
She alleged the boy (nearly 6ft tall) shoulder barged her (she is <5ft) in a stairwell where there is no cctv. When she told the story first time it was only her and the boy present.
On her second retelling of the story, suddenly she had a friend with her.
Her third version of events stated the boy, his girlfriend and approximately 50 other students were present - quite the inaccuracies already.
When the matter was first reported the school staff and on site police (who had working at school for some years and knew the kids well) knew it was fabricated based on the bullying actions of the 16 year old girl and the good characters of the boy and his girlfriend.
Fast forward a week and suddenly a witness has come forward and a new cop is in place at school.
The cop is refusing to listen to school staff. He is refusing
to fully investigate, only taking the statements from the alleged victim and her witness, who happens to be a friend of hers (conveniently), not taking the previous statements into account, or speaking with the teachers it was first reported to.
The cop stated that as there is a witness to say it happened, it must have happened.
Regardless of the fact that there could be 50 potential witnesses to state nothing happened.
The cop stated the matter would be referred to social work, via EEI, at which point social work would call school and parents for context, both parents and school will rubbish the claims and state the facts that it didn’t happen and is being fabricated, etc. The cop stated, to both the school staff and boy in question, that at this point it would go away forever.
However when the cop spoke with the parents of the boy, he stated the report would be on a police system forever, therefore lying to both the boy (who could be adversely impacted regardless of innocence)
The info would be accessible by anyone in Police Scotland and would offer an inaccurate background picture of the boy in question.
During the call to the parent, the cop was arrogant, aggressive, unprofessional and displayed no sympathy or empathy, even when the parent related the matter to his family ‘what if this was your son?’
During the school meeting, prior to the call to the parents, the cop was also arrogant and overall very nonchalant, acting as though he didn’t care that the boy was being wronged by both the bullies and the system.
As well as this, the cop in question attends the same gym as the boy in question, and repeatedly stares at the boy, in what the boy feels is a bizarre form of intimidation (there are witnesses to his behaviour at the gym)
Added to this, the boyfriend of the alleged victim, continually tries to befriend the boy in question, following him on social media and liking every post - this is not the actions of a boy who’s girlfriend has been assaulted.
There are other factors to bring into account, including the fact that the girlfriend of the boy in question, has repeatedly been punched, kicked, pushed downstairs, and threatened with murder, yet nothing has happened to her attackers / bullies (the same ‘alleged victim’ and friends)
Please provide advice on the position of the 17 year old boy, as he is being wrongfully accused and forced to accept the EEI ‘punishment’ as his only option, with the lasting impact of being named on a police database.
