I’m looking for advice or if you can point me in the direction of someone .
I got a small claims summons against me today from a fellow former colleague.who I’ve had no contact with for over a year.
quick run down
we both worked for the same company . A few of us did but I was the boss . Not a director or owner just an Employee.
the owner started missing wages and accounts with suppliers so I said I would foolishly start up another company to re open accounts to keep things going . He then asked me if I could put through some of the sales through it which is when they invoiced the new company for the jobs then he started not paying my wages or the other joiners . And asked could I pay the joiners wages for a few weeks from that company and invoice his company ( the one we all worked for ) and he would reimburse reimburse me the following month . So I did .
cut a long story short one of the joiners left then we all had to leave as got no wages and the joiner who left over a year later is basically suing me and the company I started up which only lasted 3 months and says I owe him a weeks wages plus holiday pay etc to around £1500,
inhave evidence of his contract . Wage slips everything proving he worked for the company we were both employed at and not the company I set up trying to help to keep us all in a job . I lost out on a lot of wages and now I have this at my door . Extremely stressful as I haven’t been able to secure work since it all happened a year ago .
but Iam unable to know why he is so sure he will win at court unless he knows something I don’t .
I also can’t get a CCJ against me or it will ruin my credit . Sorry for the long post .
ps I’m in Scotland , don’t know if legally that’s different here .
