  • Non harassment order.

    Hello,

    I hope can get the answers I need on here as it’s unclear by my own google search and I’m reluctant to go to police with concerns for reasons I’ll post below.

    I have a neighbour who was made subject to a one year non harassment order in sheriff court after receiving a conviction for abuse and harassment of his pregnant partner.
    They got back together in breach of his bail before he even received the order and have been living together ever since.

    The order was issued against him beginning of May,around 3 months ago now.

    Sadly the abuse continues and I’ve heard some horrific things coming out of their house but have been reluctant to involve myself as he has serious violent offences on his record,serving several lengthy jail terms for them and I’ve got young children in my house so fear any retribution if I get involved.

    So my questions are-

    is it possible to find out if the order is still in place from the police or elsewhere without making an actual complaint and what are the chances that the order could or would be overturned if he had appealed it and she was in favour of it being done away with?

    I don’t want to report the next time I hear abuse to the police only for it to turn out the order no longer applies and she doesn’t make a complaint.

    Also do non harassment orders issued by sheriff court definitely come with powers of arrest attached?
    Is it a definite criminal offence to breach it?
