  • Nolans/ Cabot simple procedure help

    Hello, I had let a cabot arrangement default and hadn't kept track, I've had a lot to deal with though I know this isn't an excuse. It was sent to Nolans and twice i sent them back income expense forms, they conveniently claim they have received them and last Monday I received Court Papers. I emailed and offered them installments but i was told reply to court and today i asked if i could offer a reduced settlement, as a family member will help me. They responded saying u less I pay £884.55 plus court expenses it will not be dismissed. Is it really not possible to offer a reduced settlement? Also the court papers ask for £884.55 not the expenses they add in today's email. I was going to offer £500 as a full and final settlement.
    can anyone advise please?

    I take it that you are in Scotland, if you can get the claim against you to a stage where the Court thinks ADR would help, then you would be in a position to negotiate a settlement. Read no.11 in the link below:

    Also any offers you make, make them in writing, make sure to write 'Without Prejudice' on the letter, make sure you get Proof of Postage.
